Terms of Service
These Terms of Service (“Terms”) govern your use of the Music Scope app and the related backend services (collectively, the “Service”), provided by Marcel Witte, Hansastr. 56, 49134 Wallenhorst, Germany (“we”, “us”, “Provider”).
1. Acceptance of Terms
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
Music Scope is a music analytics service for electronic music artists. It aggregates publicly available data from third-party streaming and chart platforms (such as Spotify, Beatport, SoundCloud, Traxsource, Shazam, and Apple Music) and presents trends, milestones, and event feeds for the artists you connect.
The Service is offered in five tiers — Free, Solo, Team, Agency, and Label — described in Section 4 below.
3. Accounts
- You must be 18 years or older, or have the consent of a parent or legal guardian, to create an account.
- One account per person. Account sharing or reselling of accounts is not permitted.
- You are responsible for maintaining the confidentiality of your credentials and for all activity on your account.
4. Subscription Tiers
The prices below are baseline EUR prices. The actual price you pay may differ depending on your region and currency, as determined by Apple in accordance with its In-App Purchase pricing matrix. The price displayed on the App Store at the time of purchase is the binding price.
| Tier | Includes | Price (baseline) |
|---|---|---|
| Free | 1 artist, 30 days of historical data, no Track Details, no Playlist Details, no Custom Social Cards. | Free |
| Solo | 1 artist, all features, full historical data since artist registration on Music Scope. | €4.99 / month |
| Team | Up to 5 artists, all Solo features. | €9.99 / month |
| Agency | Up to 15 artists, PDF reports. | €14.99 / month |
| Label | Up to 50 artists, white-label reports, data export (CSV). | €34.99 / month |
5. Free Trial
- New users are eligible for a 30-day free trial of the Solo tier.
- If you do not purchase a paid subscription before the trial ends, your account is automatically downgraded to the Free tier.
- To prevent abuse, we use Apple DeviceCheck to enforce one trial per device. Repeated attempts to obtain additional trials on the same device may be denied.
6. Billing
- All paid subscriptions are billed monthly via Apple In-App Purchase.
- You can cancel your subscription at any time from iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
- Refunds are handled exclusively by Apple. Please direct refund requests to Apple Support; we have no ability to issue refunds for In-App Purchases.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
7. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the app or backend.
- Scrape, crawl, or otherwise extract data from the Service in an automated manner.
- Resell, redistribute, or sublicense the data or insights provided by the Service.
- Create multiple accounts to circumvent tier limits or trial eligibility.
- Use the Service to track or profile individuals without a valid legal basis.
8. Data Source Disclaimer
The analytics shown in Music Scope are derived from public data published by third-party platforms. We do not control these sources. We make no warranty as to the accuracy, completeness, or timeliness of the data, and downtime, rate-limiting, or API changes on these third-party platforms may affect the availability or freshness of analytics in Music Scope.
9. Intellectual Property
The Music Scope app, its source code, design, branding, and the Service infrastructure are owned by Marcel Witte. You retain all rights to your own data, including the streaming platform accounts you connect; you grant us only the limited rights necessary to operate the Service for you.
10. Termination
- You can delete your account at any time from within the app. Deletion follows the retention rules described in our Privacy Policy.
- We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.
11. Limitation of Liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, except as required by mandatory law.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Our aggregate liability arising out of or relating to the Service is limited to the total amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
The above limitations do not apply to liability for intentional acts or gross negligence, nor to liability for damages arising from injury to life, body, or health, nor to mandatory statutory liability under German law (including the Produkthaftungsgesetz).
12. Changes to These Terms
We may update these Terms from time to time. The current version is always available here, with the Last updated date at the top. For material changes, we will notify you in advance by email or via in-app notification. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is Osnabrück, Germany, to the extent permitted by law.
Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected by the choice of law and forum above.
